1. Acceptance of Terms
Welcome to Dawsonptx.com. These terms and conditions outline the rules and regulations for the use of our website and services. By accessing and using our website, you agree to comply with these Terms. If you do not agree with these Terms, please refrain from using our website.
2. Services Offered
a. Studio Time: Upfront fee covers hourly production and audio engineering costs. You will receive a demo at the end of your session of what was completed within the time frame. Session files and stems are available upon request. Address to location will be emailed to you upon booking. Session start time begins at the schedule time, regardless if the artist is present or not. Prices may vary based on location.
b. Mixing & Mastering: We offer many different mixing and mastering packages each of which slightly differ from the next. We encourage you to pick the one that best suits your needs. If you are unsure please reach out and we will be happy to help you figure out which package is best suited for your needs. Every mixing package covers vocal editing and tuning, instrumentation balance, instrumentation effects such as EQ, compression, reverb etc, a set amount of revisions, delivery via email in high quality WAV & MP3 format. What is included in these packages may be subject to change based on your needs and what works best for the project. After receiving payment and approving that the files are ready to mix, we will work diligently to get you a mix he feels is ready for publication within 3-5 days. We will then give you time to listen back to the mix and curate a list of any changes you may want. We will book a 1 hour, one on one studio session either in person or remote, where we will then make these changes. Although timeline varies from project to project we hope to have the entire process wrapped up within 7-10 days. Every Mix package we offer comes with a 1 hour, one on one studio session either in person or remote, where we will address revisions. Each package also comes with 2 additional revisions. These are used for anything after the one on one session where after listening for a week you feel like your vocal isn’t loud enough, we will go back and fix this for you. We will do this twice. Any time spent on your mix/master which is beyond what’s included in your purchased package will be charged hourly. After approval & delivery of the final Mix/Master, we will hold your files for 30 days. After 30 days we are no longer responsible for your files. Please let us know if you wish to get a copy of your session file prior to the finalization of your project.
c. Digital Downloads: In exchange for your payment associated with the applicable product we grant you a non-exclusive, non-transferable, perpetual right to use the products. These products may not be redistributed, resold or repackaged in any way. Specific to our digital sound kits (Sample Kits, Compositions Packs, Drum Kits, MIDI Kits etc): In exchange for your payment of the license fee associated with the applicable sound(s) and/or sample(s) provided via this website, we grant you a non-exclusive, non-transferable, perpetual right to use the sounds in combination with other sounds in music productions to create new recordings, which shall be considered "derivative works". This license permits you to modify, reproduce, publicly perform, distribute, transmit, sublicense and otherwise use the Sample as incorporated in your Recording, including for commercial purposes, subject to the following restrictions: You may not use or sublicense the Sample in isolation as sound effects, loops, or as source material for any other form of sample (even if you modify the Sample); You may not use or sublicense Samples in a manner competitive to us or redistribute Samples in new sample packs; You may not sublicense, sell, loan, share, lend, broadcast, rent, lease, assign, distribute, or transfer any Sample to a third party except as incorporated into a Recording; You may not use the name, image, or likeness of the artist or producer associated with a Sample in any way without that artist's or producer's express written permission. Furthermore, with respect to commercial usage of Recordings containing Samples, please read the usage terms contained within each digital download which outline the terms of use specific to that digital product. All digital downloads sold will be emailed to you. Please double check your spam folder if you do not receive your product within 24 hours. If you still have trouble receiving your product please contact us.
3. Ordering and Payment
a. To purchase audio products or book studio time, you may be required to provide accurate and current payment information. We reserve the right to decline or cancel any order at our discretion.
b. Payment for products and services is due at the time of purchase. All prices are listed in CAD currency.
4. Intellectual Property
a. The content sold and displayed on our website is protected by intellectual property laws and is the property of Dawsonptx.com and it’s licensors.
b. You may not reproduce, distribute, modify, or otherwise use our content without our explicit written permission.
6. Returns, Refunds & Cancellations
a. Due to the nature of downloadable products, Dawsonptx.com does not offer refunds or returns on any digital products (includes but not limited to Drum Kits, Sample Kits, MIDI Kits, Informational PDFs etc). Any refund request will be considered in our sole discretion and our decision will be final. If you did NOT receive your download links and/or having trouble with your digital files, please contact us.
c. Cancellation fees vary on studio location. Solomon Studios offers a 48 hour policy where if you cancel 48 hours prior to your session start time we offer a full refund. Anything within 48 hours we offer a 50% refund. Same day cancellations have a no refund policy. Other locations (Including but not limited to Toronto, Mississauga & Vaughan) reserve the right to not offer a refund on any cancellations. Some locations may offer to reschedule once with no additional payment, but this is not guaranteed.
7. Limitation of Liability
a. Dawsonptx.com (Dawson) shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use of our products or services.
8. Termination
a. We reserve the right to terminate or suspend your access to our website and services at our discretion, without notice.
9. Changes to Terms
a. We may update these Terms at any time without prior notice. It is your responsibility to review the Terms periodically for changes.
10. Governing Law
a. These Terms are governed by and construed in accordance with the laws of Ontario, Canada. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Ontario, Canada.
By using our website and services, you acknowledge that you have read, understood, and agreed to abide by these Terms and Conditions.
11. Privacy Policy
a. Collection of personal information: Upon visiting the Site, specific information about your device is automatically collected, including details about your web browser, IP address, time zone, and certain cookies installed on your device. Additionally, as you navigate the Site, information is gathered about the individual web pages or products you view, the websites or search terms that referred you to the Site, and how you interact with the Site. This automatically-collected information is referred to as Device Information. When you make a purchase or attempt to do so on the Site, specific information is collected, including your name, billing address, shipping address, payment details (including credit card numbers), email address, and phone number.
b. Utilization of personal information: The Order Information collected is primarily used to fulfill orders made through the Site. This includes processing payment information, arranging shipment, and sending invoices and/or order confirmations. Furthermore, the Order Information is utilized for the following purposes; Communication with you, Scrutinizing orders for potential risk or fraud, & Providing information or advertising concerning products or services in accordance with your preferences.
c. Sharing of personal information: We may share your information with Third Parties in If we believe the release of information about you is necessary to respond to a legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction. We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance. We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law.
d. Security of Your Information: We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.
e. General Privacy: Respect the privacy of all participants. Do not share any recorded material or studio-related information without proper authorization. Confidential information under this Agreement includes, but is not limited to: Audio recordings, music compositions, lyrics, and any other creative material produced during recording sessions; Financial and business information related to the Studio's operations; Any other non-public information exchanged between the Studio and the Client that is reasonably considered sensitive.
f. Emails and Communications: If you wish to no longer receive communications from us you may unsubscribe by clicking “unsubscribe” at the bottom of our emails or emailing dawson.ptx@gmail.com.
